Terms of Service

These Terms of Service (the "Terms") are an agreement between you and SpotOn ("we", "us", or "SpotOn"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use SpotOn.
These Terms must be read together with our Community Guidelines, our Privacy Policy, and our Safety Policy. Together they form the agreement between you and us.
1. Who can use SpotOn
You may use SpotOn only if all of the following are true:
- You are aged 18 or over.
- You can form a binding contract under UK law.
- You have not previously been removed from SpotOn for breaching these Terms or our Community Guidelines.
- You will use SpotOn in line with these Terms, the Community Guidelines, and applicable UK law.
You must provide accurate, current information about yourself when signing up and as your circumstances change.
2. Your account
Eligibility and verification
You agree that the information on your profile is truthful, including your first name, age, gender, gym, and photos. Misrepresenting these is grounds for account removal.
Security
You're responsible for the security of your account. Don't share your login codes. If you suspect someone else has accessed your account, contact us at hello@spoton.app and we'll lock it.
One account per person
You may hold only one SpotOn account at a time. Creating duplicate accounts (or returning after a ban under a new identity) is a breach of these Terms.
Your content
"Your content" includes your profile, photos, posts, messages, reports, and anything else you upload or send via SpotOn.
You keep ownership of your content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to use it only as needed to run the service:
- Show your profile and posts to other users in line with your visibility settings.
- Deliver your messages to the people you've sent them to.
- Back up, transmit, format, and display your content to operate the service.
- Use anonymised, aggregated data to improve the product (e.g. "most popular goal at London gyms").
This licence ends when your content is removed from SpotOn (whether by you, or by us under these Terms), except for content already shared with other users (e.g. messages you sent) and any backups retained in line with our Privacy Policy.
You promise that you have the right to share whatever you upload, and that nothing you upload infringes anyone's rights or breaks the law.
3. How you must behave
You must follow our Community Guidelines at all times. The Community Guidelines are part of these Terms.
You must not:
- Harass, threaten, bully, stalk, intimidate, or sexually harass any other user.
- Send unsolicited sexual content of any kind.
- Photograph or film anyone without their clear, contemporaneous consent — and never in a changing room, shower, or any private area.
- Discriminate against or attack other users based on a protected characteristic (race, ethnicity, religion, gender, gender identity, sexual orientation, disability, age, body size, or any other characteristic protected by UK law).
- Impersonate anyone, use a name other than your real first name, or use someone else's photos.
- Lie about your age, gender, or gym.
- Promote paid services, MLM schemes, scams, or other commercial activity through SpotOn without our written agreement.
- Use SpotOn to facilitate any illegal activity, including drug supply, weapons sales, or doping.
- Send, request, or solicit child sexual abuse material. This will result in immediate removal and a report to UK authorities.
- Scrape, copy, or systematically extract data from SpotOn.
- Reverse-engineer the service, attempt to bypass security, or access parts of the system you're not authorised to access.
- Use bots, scripts, or automated tools to interact with other users.
- Interfere with the service or other users' enjoyment of it.
Behaviour outside the app — between SpotOn users — that breaks these rules can still lead to account removal.
4. Reports, suspension, and removal
How reports work
We accept reports from any user. We review every report. We weigh reports against conversation history, prior reports, and severity.
Possible outcomes
Depending on what we find, we may:
- Take no action and inform the reporter.
- Issue a warning to the reported user.
- Remove specific content (a post, a message, a photo).
- Suspend the reported account temporarily.
- Permanently remove the reported account.
- Block the associated email or phone from re-registering.
- Report the matter to UK police or other authorities.
Some behaviours skip the ladder. Sexual harassment, threats of violence, hate speech, photographing someone in a changing room, and any contact involving a minor result in immediate permanent removal.
Our discretion
We can suspend or remove your account at any time if:
- We believe you've breached these Terms or our Community Guidelines.
- A court, law-enforcement agency, or regulator requires it.
- We need to protect SpotOn, our users, or third parties.
Where reasonable, we'll tell you the reason and give you a chance to respond. For severe breaches, no notice will be given.
Appeals
If we remove your account and you believe it's a mistake, email appeals@spoton.app within 30 days. We'll review.
5. Pause and delete
You can pause your account at any time — you'll disappear from Discover and from non-connection profile views, but your existing chats keep working. You can unpause from Settings.
You can delete your account at any time. Deletion starts a 30-day grace window. If you log in inside that window, your account and data are restored. After 30 days, your account and personal data are permanently removed, except for data we are legally required to retain. See the Privacy Policy for full retention details.
6. Meeting up
SpotOn lets you meet people who train at the same gym you do. You arrange your own meet-ups. We are not a party to those arrangements.
You agree that:
- You meet other users at your own risk.
- You will exercise reasonable judgment about who you meet and where.
- SpotOn is not responsible for the conduct of other users in real life.
- SpotOn does not verify users' identities, criminal-record status, or gym membership (subject to any verification features we add later).
This does not limit any duty of care we owe you in respect of how we run the service itself — only how we relate to in-person interactions between users.
7. Content from other people
Profiles, photos, posts, and messages on SpotOn are created by users — not by SpotOn. We do not check or verify user content before it's published. We do moderate content following reports, and we may remove content that breaches these Terms.
We are not responsible for what other users say or do, but we may remove their account if they break the rules.
8. The service itself
Availability
We aim for SpotOn to be available 24/7, but we don't guarantee uninterrupted service. We may need to take it down for maintenance, security, or upgrades. We will give reasonable notice for planned outages where we can.
Changes
We may change SpotOn's features at any time. We may add new ones, remove old ones, or limit access to certain features by gym, region, or user category.
Beta / early-access features
Some features may be marked as "beta" or "early access." These may break, behave unexpectedly, or be removed entirely. Use them at your own risk.
Free service
SpotOn is currently free to use. If we introduce paid features in the future, we will give you advance notice and clear pricing before any charge is taken. Existing free features will not retroactively become paid without notice.
9. Intellectual property
SpotOn — including the app, the website, the brand, the wordmark, the animated mark, the design, and all underlying code — is owned by us or licensed to us. You may not copy, modify, distribute, or commercially exploit any of it without our written permission.
You keep ownership of your content (see Section 2).
10. Liability
What we are responsible for
We are responsible for losses that you suffer as a direct, foreseeable result of our breach of these Terms, or our negligence, but only up to the amount we have charged you in the previous 12 months. Since SpotOn is currently free, this currently caps at £100.
What we are not responsible for
We are not responsible for:
- The conduct of other users — online or in person.
- Loss or damage that wasn't reasonably foreseeable.
- Loss or damage caused by your own breach of these Terms.
- Loss of business, profits, or income — SpotOn is a consumer service, not a business tool.
- Outages caused by your internet provider, your device, or third-party services we rely on.
What we cannot exclude
Nothing in these Terms limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be limited under UK law.
If you are using SpotOn as a consumer (which most users will be), nothing in these Terms affects your statutory rights under UK consumer law.
11. Indemnity
If your breach of these Terms (including the Community Guidelines) causes us to suffer loss — for example, a claim brought by another user against us because of something you did — you agree to cover the reasonable costs of dealing with it, including legal fees.
This applies only to claims caused by your wrongful conduct. It does not apply to claims caused by our own wrongful conduct.
12. Changes to these Terms
We may change these Terms. When we do, we will:
- Post the new version at justspoton.com/terms and in the app.
- Update the "Last updated" date.
- Notify you of material changes via the app and/or by email.
For material changes that adversely affect you, we'll give at least 30 days' notice before they take effect. If you don't agree to the changes, you can delete your account before they apply. Continued use after the effective date means you accept the new Terms.
13. Termination
You can stop using SpotOn at any time. Pausing or deleting your account is the simplest route.
We can terminate or suspend your access if you breach these Terms (see Section 4).
When these Terms end:
- We delete or anonymise your personal data as set out in the Privacy Policy.
- Sections of these Terms intended to survive — including the licence in Section 2 (for content already shared), Section 9 (intellectual property), Section 10 (liability), Section 11 (indemnity), and Section 15 (governing law) — continue to apply.
14. Other legal terms
Assignment
You may not assign or transfer your rights under these Terms. We may assign or transfer ours, but not in a way that reduces your rights as a user.
No partnership
Nothing in these Terms creates a partnership, agency, or employment relationship between you and us.
Whole agreement
These Terms, together with the Community Guidelines, Privacy Policy, and Safety Policy, are the whole agreement between you and us about SpotOn. They replace any prior promises or representations.
Severability
If any part of these Terms is found to be unenforceable, the rest still applies.
Waiver
If we don't enforce a part of these Terms, that doesn't mean we've waived it. We can still enforce it later.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales.
If a dispute arises that we can't resolve informally, you and we agree it will be dealt with in the courts of England and Wales — unless UK consumer law gives you the right to bring it elsewhere.
Before starting court proceedings, we'd ask you to email hello@spoton.app so we can try to resolve it directly. Most issues are resolved this way.
